The American Civil Liberties Union (ACLU) filed a lawsuit Monday in the U.S. District Court of Columbia, against President Trump, Vice President Pence, and the Presidential Advisory Commission on Election Integrity committee.
The ACLU is not happy with President Trump’s probe into election fraud and his request for all states to turn over their voter data, claiming that it is a violation of the Federal advisory Committee Act (FACA).
First, the ACLU stated that the 15-member commission, headed by Vice President Mike Pence and Vice-chairman Kris Kobach, has already held its first meeting without public notice, and has failed to make any of its records available for public inspection.
Next, they allege that President Trump has not been “fair and balanced” in regards to the people he has assigned to the commission. The ACLU alleges in their lawsuit that “the Commission was established for the purpose of providing a veneer of legitimacy to President Trump’s false claim that he won the popular vote in the 2016 election—once millions of supposedly illegal votes are subtracted from the count. That purpose is evident in the composition of the Commission, which is stacked with individuals who have endorsed the President’s false statements about the popular vote, and the fact that no provisions whatsoever have been made to insulate the Commission’s advice and recommendations from inappropriate influence by the person who appointed the Commission’s members—i.e., President Trump himself.”
So far, just one state – Arkansas – has submitted the voter registration data as requested by the Election Integity committee.
According to The Hill, at least 44 states have refused to turn over the requested data.

However, the ACLU’s lawsuit Monday is seeking to put the brakes on any investigation into the matter.
