Denver Murder Suspect Flagged by ICE Before Killing


On Feb. 8, illegal alien Ever Valles was arrested for the suspected murder-robbery of Tim Cruz, who was killed on Feb. 7 while waiting for a Denver RTA monorail.

Friday, both Valles and alleged accomplice Nathan Valdez were officially charged with one count of murder along with other gun, robbery and kidnapping charges in the wake of Cruz’s death.

Prior to the murder, on Dec. 20, Valles was released from the Denver county Jail, despite being marked by Immigration and Customs Enforcement.

Flagged as an “immigration enforcement priority”, Valles was meant to be placed into federal custody as protocol follows. Though Valles was tagged with a detainer order, ICE was never made aware of Valles’ release until after he was already back on the streets.

“The detainer wasn’t honored,” an ICE statement read. “He was released by the jail on Dec. 20, 2016, without notification to ICE.”

Higher-ups of the Denver jail purport a fax was delivered to the resident ICE office at 11:33 PM on Dec 20, the night Valles was set free. ICE officials claim the fax wasn’t received for another 54 minutes.

The Denver Sheriff’s office also issued a statement today, saying in part, “Denver has never and will never advocate for felons to remain on our streets — immigrants or not.”

Valles, a Mexican resident, was sought by ICE for federal detainment “due to his criminal history and gang affiliation.”
