Former Omaha officer surrenders to face assault charge

A former Omaha police officer has surrendered to face a felony assault charge after killing a mentally ill man he shocked with a stun gun numerous time.

Officials say Scott Payne surrendered Friday around 5 a.m. He is currently awaiting a bond hearing.

Surveillance video shows Payne using a stun gun on 29-year-old Zachary Bearheels at an Omaha convenience store. Payne’s partner, officer Ryan McClarty, is seen punching Bearheels, even after Bearheels was on the ground and not resisting.

McClarty has been ticketed for misdemeanor assault.

Authorities said Bearheels was being aggressive and fought officers’ efforts to take him into custody. He was pronounced dead later at a Nebraska hospital.
