When an Oklahoma man and his wife decided to divorce, he asked for a paternity test of their three-year-old son.
The test revealed that the child was not his. Regardless, he will still be required to pay child support for the toddler.
Thomas (who gave no last name), said that he married his girlfriend after she became pregnant in high school. At the time, he had no reason to think that the child did not belong to him, therefore, he didn’t initially ask for a paternity test.
Three years later, while going through divorce proceedings, Thomas said that something inside urged him to ask for a paternity test on the toddler.
Twice, the test returned results verifying that he was not the biological father of the child. However, in Oklahoma that is not an important factor in determining responsibility for dependents, as the state declares that you must question paternity of a child within two years.
News On 6 reported that the judge, who initially ruled in favor of Thomas, ordered him to pay $500 per month in child support, along with $15,000 in back support, plus interest.
“I wish I was telling a lie. I wish it wasn’t the truth but it is,” Thomas said of the ordeal. “That’s what makes it so crazy. Everyone I talk to about this can’t believe where the court system is coming from,” he continued.
Thomas accepts the court ruling, but is working to change the outrageous law that left him deep in debt.
“At this point, there’s really nothing I can do to get out of the $15,000 or get out of the child support. It’s done, it’s the law.”
Oklahoma law would allow the child’s mother and biological father to forgo the child support, however, without their consent Thomas will be liable for child support for the next 15 years.
