Trump supporter gets the victory in free speech battle.
Joe Hornick, a former firefighter, knows how to fight for what he believes in – and he just won a battle with his town to keep flying his Trump flags.
Hornick was ticketed in March for “violating a city ordinance” prohibiting the public display of political lawn signs more than 30 days before an election. He was facing 90 days in jail and up to a $2,000 fine. SEE STORY HERE.
But, he didn’t have any yard signs – it was his two Trump flags, flying high on a flag pole, the city was displeased about. He refused to take them down. He was prepared to go to jail, if necessary.
Wednesday a New Jersey municipal court judge dismissed all charges. “This matter is dismissed. I’ve looked at the ordinance as well and I agree with counsel it’s somewhat vague as to whether the flag applies or not,” Judge Louis Garippo, Jr. said. “So in the interest of justice, this is dismissed.”
“Let the flags fly. Let ’em fly,” Hornick said after court. “You take my freedom away, I’d rather sit in jail, bottom line.”
With him in court was his own lawyer Eric Sherman, plus an attorney from the American Civil Liberties Union.
Sherman said the town is now in the process of drawing up a new ordinance that will address the issue of political signage clutter, without violating the rights of residents.
New Jersey primary election is June 7th. Hornick will be ready, with flags flying.
