NYC Bartenders Cannot Refuse to Serve Pregnant Women


WARNING: Drinking alcoholic beverages during pregnancy can cause birth defects.

If that message doesn’t stop an expectant mother from ordering alcoholic beverages, New York City law says the bartender cannot refuse to serve her.

The new guidelines read:  “Judgments and stereotypes about how pregnant individuals should behave, their physical capabilities and what is or is not healthy for a fetus are pervasive in our society and cannot be used as pretext for unlawful discriminatory decisions” in public venues.

Bar_Pregnancy WarningSo, according to New York City, the warning label is just based on “judgements and stereotypes” and not actual medical PROOF.

Ultimately, however, bartenders say, the responsibility and the decision should be up to the woman.

Some states allow criminal charges against women who use illegal drugs while pregnant or permit detaining expectant mothers who drink heavily.

The U.S. Surgeon General and major medical associations say women should avoid alcohol during pregnancy. An American Academy of Pediatrics reiterated the admonition last October.
