Multiple major media outlets may be in hot water over their contracts with a prominent illegal alien, according to an exclusive report by the Daily Caller News Foundation.
Several legal professionals have agreed that Jose Antonio Vargas, an illegal alien in the United States, has been contracting out to multiple media companies, including CNN, The Washington Post, the Los Angeles Times, Huffington Post, New York Times, and the Greater Talent Network Speaker’s Bureau.
Vargas also directed a documentary for MTV called “White People.”
“Acquisitions of Vargas’s labor appear to violate the Immigration and Nationality Act 274A – Unlawful Employment of Aliens of the United States Citizenship and Immigration Services (USCIS) code,” the Daily Caller reports.
Vargas is reportedly the founder and CEO of two nonprofit LLCs in the U.S., Define American Inc., and #EmergingUS LLC. He is also a “majority manager” for the nonprofit, Undocumented, LLC.
The Daily Caller noted that Define American is an organization that appealed to the Hillary Clinton and Bernie Sanders campaigns, as well as media outlets such as NBC and the Associated Press, to stop using the term “illegal” when describing “undocumented immigrants.”
Jan C. Ting, a former official with the Immigration and Naturalization Service (INS), explained, “The key word in the statute is the hiring of an alien knowing the alien is unauthorized. So, the statute of subsection A4 says entering into [a] contract with someone is the same as hiring, so A4 takes you up to A1A, which says now since it’s considered hiring, the hiring of someone, an alien, knowing the alien is unauthorized, is unlawful.”
According to a website of one of his nonprofits, Vargas is trying to use the reasoning that he is a “job creator.”
“Despite being undocumented, Jose is actually a job creator,” the #EmergingUS website reads. “Though undocumented people can’t be knowingly employed by others, they can create their own businesses and hire employees.”
The Daily Caller also revealed additional alarming facts surrounding the ability of illegal aliens to register LLCs within the United States:
TheDCNF spoke with a lawyer and certified public accountant who confirmed, under the condition of anonymity, that people can register LLCs using a Social Security number (SSN) or an employment identification number. As an illegal alien, Vargas would not have an SSN, but he could obtain an employment identification number with an individual taxpayer identification number (ITIN), which allows illegal aliens to pay taxes. Both Social Security numbers and ITINs are nine digits in length. Some states check to see whether the number used to register an LLC is an SSN, but others do not. None of this prevents illegal aliens who own LLCs from being deported, according to the Immigration and Nationality Act Section 237 (a)(1)(b).
In April, Vargas was interviewed by Bill Maher, who proclaimed, “You are literally risking deportation, because you are not completely, legal, is that correct?”
Vargas proudly confirmed that was true.
