The mother of a 4-month-old baby intentionally set the fire in her Alabama apartment that killed her child, police said.

Ashley Nicole King was charged with capital murder Wednesday following the deadly blaze, Phenix City Captain of Investigations Darryl Williams said. Under Alabama Criminal Code, the charge is applied for the intentional death of a child under the age of 14.

Firefighters responded to the fire at around 10:14 a.m. King was pulled from the apartment, but it was only when neighbors began to ask where her child was that firefighters went back to the apartment and located the baby, Williams said.

“There had been several residents outside that said they thought there was a child inside the apartment,” he said.

The child had suffered from severe burns and was transported to a hospital in Columbus, Georgia, but was pronounced dead on arrival. The child’s body will be sent to the Alabama Forensics Crime Lab for an autopsy.
