Shia LaBeouf is being sued by a Los Angeles bartender after a heated exchange broke out between the two men last month over the employee’s refusal to serve LaBeouf a drink.

The public altercation erupted in swearing and LaBeouf calling the bartender, David Bernstein, a “f—ing racist bitch,” which was caught on camera by a supervisor at Jerry’s Famous Deli. The video of his verbal tirade has since gone viral.

According to court documents, Bernstein confirmed the “Transformers” star’s outburst resulted from the bar refusing to serve both LaBeouf and his wife.

The NY Daily News reports the star and his wife Mia Goth were at the Pinz Bowling Alley in L.A. on April 5, when Goth went next door to the bar.

The bartender refused to serve her because she appeared to already be heavily intoxicated. LaBeouf then appeared by her side and demanded his wife be served, says the lawsuit, adding that he was apparently drunk at the time.

Tensions escalated when he slammed his fist on the bar and “quickly proceeded around the corner of the bar and entered the bartender well area… while yelling at the top of his lungs and appeared ready to physically confront Mr. Bernstein,” the lawsuit states.

Bernstein was “fearful of an imminent attack” and used a bottle of Grey Goose vodka bottle to deter the actor.

As LaBeouf was being escorted out of the bar, he was heard yelling “Wake Up, this Mother F—– is a Racist,” in an effort to upset the predominately African-American customers at the bar, according to the legal documents.

The lawsuit also states that Bernstein “experienced significant emotional distress, anxiety and fear” as a result of the altercation and has since been exposed to “significant embarrassment and ridicule” since video of the incident went viral. He has been called “the racist bartender” by the fans of the actor online, reports The Hollywood Reporter.

Bernstein is seeking $5 million in damages for assault and defamation.

The incident is one of a series of public scuffles of late, including LaBeouf’s arrest in New York City last January after an altercation broke out during his anti-Trump performance art project.
