A suburban mother of four has claimed she was engaged in “legitimate warfare” after being charged with conspiring to provide material support and resources to ISIS.

Schiller Park, Illinois resident Mediha Medy Salkicevic, a Muslim refugee from Bosnia, was arrested in February of 2015 after she and several co-conspirators were suspected of funneling military gear and money to fellow Bosnian Abdullah Ramo Pazara. Investigators stated that Pazara is a known facilitator of resource transfers from American supporters to jihadist organizations in the middle east. Investigators claimed that Salkicevic wanted to “bury unbelievers alive.”

The 37-year-old is still being held without bond, but on Friday her attorneys filed a motion to dismiss the charges of conspiracy and providing to material support to terrorists on the grounds that Salkicevic is actually aiding the US military. They claimed the only thing Salkicevic is guilty of is engaging in “legitimate war” against Syrian tyrant Bashar al-Assad, just as the US has done. Thus they feel she qualifies for “combatant immunity.”

“Under United States law, acts of legitimate warfare during a civil war are not murder and are entitled to combatant immunity,” the defendants stated. They said as an American, Salkicevic is “protected from prosecution as acts of legitimate warfare under the doctrine of combatant immunity.”

Their argument may have had the opposite effect however. In attempting to prove the legitimacy of Salkicevic and Pazara’s statuses as “combatants” the attorneys Friday provided numerous photos of him with automatic weapons and bandoliers of ammo strapped to his sides. In 2013, Pazara’s organization allegedly provided foreign fighters in Iraq and Syria with U.S. military uniforms, tactical clothes and gear, combat boots, military surplus supplies and other items.

Earlier today a report was released about ISIS’ plummeting numbers.
