FIRST ON FOX: A coalition of 20 states and a top conservative legal group is suing the Biden administration over its recently-expanded humanitarian parole program that allows tens of thousands of migrants from designated countries a month into the U.S. — arguing that the program is unlawful.
The lawsuit, filed by Texas and America First Legal in the Southern District of Texas, is joined by 19 additional states who are seeking to block the Biden administration’s parole program which allow up to 30,000 migrants from Haiti, Nicaragua, Cuba and Venezuela into the U.S. each month.
The Biden administration announced the program for Venezuelans in October, which allowed a limited number to fly directly into the U.S. as long as they had not entered illegally, had a sponsor in the U.S. already and passed certain checks.
Biden then announced earlier this month that the parole program would be expanding to include Haitians, Nicaraguans and Cubans, and said up to 30,000 migrants would be allowed into the U.S. monthly from these countries. To participate in the program, Biden declared the migrants would need to use an app to make an appointment in advance to apply for asylum.
Customs and Border Protection touted the program on Twitter this week, tweeting, “ALERT: Qualifying nationals from Cuba, Haiti, Nicaragua & Venezuela must follow the online process to seek advance authorization to travel to the US. Those who enter the US, Mexico or Panama w/out authorization will be ineligible for these processes.”

Texas Attorney General Ken Paxton announced Tuesday afternoon, “I’m leading a powerful 20-state coalition suing the Biden Admin to stop the implementation of their new & unlawful amnesty plan, which would invite hundreds of thousands of foreign aliens to reside in the United States every year.”
Joining Texas in the lawsuit are the following states:
- Alabama
- Alaska
- Arkansas
- Florida
- Idaho
- Iowa
- Kansas
- Kentucky
- Louisiana
- Mississippi
- Missouri
- Montana
- nebraska
- Ohio
- South Carolina
- Tennessee
- Utah
- West Virginia
- Wyoming
In a press release, Paxton wrote:
The DHS program would establish a new visa system that would allow for up to 360,000 aliens from Cuba, Haiti, Nicaragua, and Venezuela to be “paroled” into the United States every year. But Congress has authorized parole only for foreign aliens who meet very specific standards that have not been met in this instance. Yet, contrary to existing law, the program creates a pathway for program participants to apply from their home country and gain lawful status to enter and stay in the U.S. for up to two years, or even longer.
The Biden Administration also instituted this program without engaging in the usual notice and comment rulemaking process required by law. This constitutes yet another episode in which the Administration has abused its executive authority in furtherance of its apparent objective for immigration policy: open borders and amnesty for all.
