MINNEAPOLIS (WCCO) — Attorney Eric Nelson has filed a motion for a new trial for former Minneapolis police officer Derek Chauvin in the death of George Floyd.

Nelson filed the motion on the grounds of juror misconduct, and that the court abused its discretion for failing to agree to the defense’s requests for a change of venue and sequestering the jury.

The article goes on to state the following:

The filing comes in the midst of a controversy surrounding a photo of juror Brandon Mitchell at the March on Washington last August, which included speeches from George Floyd’s family members. He is seen wearing a T-shirt that says “Get Your Knee Off Our Necks.” In his juror questionnaire, Mitchell wrote that he had not attended any protests over police brutality. Mitchell told WCCO Monday that he was at the march in support of ramping up voter turnout for the 2020 presidential election.

Mitchell argued that he would have gone to D.C. for the event, whether George Floyd was alive or not. However, he is catching backlash for having lied on the juror questionnaire.

In the photo of Mitchell at the event in D.C., he is wearing Black Lives Matter attire, including a hat that says “Black Lives Matter.”

KARE11 reporter Lou Raguse tweeted, “Derek Chauvin’s attorney Eric Nelson just filed a motion asking for a new trial on multiple grounds including jury misconduct.

“Nelson formally asked for a Schwartz hearing, in which juror Brandon Mitchell could potentially be questioned about a social media post in which he wears a shirt that says “Get Their Knee Off Our Neck” and his answers to the juror questionnaire.”

Journalist Megyn Kelly noted that Mitchell went to the event in D.C. wearing BLM attire three months after George Floyd was killed.

  2. I believe that he should have a new trial based on the fact that the juror lied on his Juror Questionnaire!! Regardless of my feelings which are not relevant here. This is only fair!

    I’m not surprised at all….and frankly, thrilled Chauvin gets the opportunity to put everything back into the chaotic victimhood perspective it is…..a pile of bull sh$t using one police officer as a scapegoat. We live in a screwy world. Time to snack the BLM idiots back down where they belong. It’s there own creation that did this.

  4. No question about Juror misconduct as the prosecution said earlier – “you just have to look at the …picture”. Tainted jury. Then you have the failure the Judge. Given the community outrage, the jury should have been sequestered. Then you have political interference of the Mayor, Congresswoman Waters and the President. Next you have the prosecution hiding witnesses. Finally you have the autopsy which determined Drugs killed him.

    The appeal should be moved to another state because a fair trial can not be had.

  5. This trial was a sham from the start. It should have had a change of venue and a sequestered jury. This group had the cop guilty before they ever heard one word of trial. The judge had no backbone either. We will see if he has developed one in order to call a mistrial.

  6. Everyone who has a common sense knew this was an unfair trial. The jurors were afraid of retaliation And also those protesters in front of the court should not be allowed, they where there not for support but to intimidated. The trial should not be in Minnesota, there won’t be a partial judge neither jurors.

    The woman officer in Brooklyn Park MN is not going to get a fair trial in Minnesota either if it’s held there.

  10. Trial, mistrial, or no trial, Chauvin’s fate was sealed after his video went viral all over the world. Mere technicalities have no meaning whatsoever in this case. Whatever is done, the outcome will be the same. In fact, it may even be worse as it would spark major rioting nationwide. So, at this point, just let it be for everyone’s sake.
