1 – Texas abortion law: Biden’s DOJ asks judge to intervene
Fox News reports: The U.S. Department of Justice late Tuesday asked a federal judge in Texas to temporarily halt the controversial new state law that bans abortions after about six weeks.
The emergency motion seeking a temporary restraining order comes days after the DOJ sued Texas over the law, claiming it was enacted to “prevent women from exercising their constitutional rights.”
The law went into effect on Sept. 1 after being upheld in a 5-4 decision by the U.S. Supreme Court. It is the strictest abortion law in the country. Critics say many women don’t yet know they’re pregnant at six weeks – around the time when a fetal heartbeat can first be detected – and the law makes no exceptions for rape or incest.
“It’s clearly unconstitutional,” Attorney General Merrick Garland said last Thursday. “The obvious and expressly acknowledged intention of this statutory scheme is to prevent women from exercising their constitutional rights.”

Garland announced last Thursday that the DOJ was filing a lawsuit against Texas over the new law.

DML: So, we’ve got the federal government calling a state law unconstitutional – the same federal government who wants to force their (unconstitutional?) mandates on the states!
2 – Arizona attorney general sues Biden over vaccine mandates
The Hill reports: Arizona Attorney General Mark Brnovich filed a lawsuit against the Biden administration on Tuesday in response to its new policy that will require private employers with 100 or more employees to mandate vaccines or weekly testing.
“The federal government cannot force people to get the COVID-19 vaccine. The Biden Administration is once again flouting our laws and precedents to push their radical agenda,” Brnovich, who is currently waging a bid for the U.S. Senate, said in a statement.
The new policy, which Biden unveiled last week, will be issued by the Department of Labor’s Occupational Safety and Health Administration “in the coing weeks.”
Brnovich’s office is arguing that the policy is in violation of the Equal Protection Clause because by “favoring migrants” who entered the U.S. at the southern border, rather than U.S. citizens. It said that by allowing migrants to decline getting inoculated, the administration is “protecting their freedom and bodily autonomy more than American citizens.”
His office said the policy represents an “unmistakable — and unconstitutional — brand of favoritism in favor of illegal migrants.”

3 – US military aid to Egypt released despite rights concerns
The Associated Press reports: WASHINGTON (AP) — The Biden administration is releasing nearly $200 million in military aid to Egypt but will hold back millions more over human rights concerns, the State Department said Tuesday in an announcement quickly criticized by rights groups and some lawmakers.
The department said Secretary of State Antony Blinken would withhold $130 million of $300 million in military financing for Egypt due to the concerns. It said he would allow the rest go through to preserve U.S.-Egypt security engagement that Washington believes is critical to Mideast stability.
The $170 million to be released will be sent using authority the administration has to waive human rights conditions placed on the assistance by Congress. Under federal law, the secretary of state must certify that Egypt is meeting those conditions or issue a waiver for the aid to be sent.
“Because we are continuing to discuss our serious concerns about human rights in Egypt, the secretary of state will not certify that the government of Egypt is taking sustained and effective steps related to the legislative human rights-related conditions” on the aid, the department said.
Nonetheless it said the administration would provide the majority of the assistance for border security, nonproliferation and counterterrorism programs while withholding the remaining $130 million. The withheld amount will be released “if the government of Egypt affirmatively addresses specific human-rights related conditions,” the department said.

4 – Afghan evacuee flights to US halted for another week amid measles outbreak
The Washington Examiner reports: All of the flights to the United States carrying Afghan evacuees have been put on pause amid a measles outbreak.
The U.S. has implemented “at least” an additional seven-day holding period starting on Monday “at the request of the [Centers for Disease Control and Prevention ],” Pentagon spokesman John Kirby announced during the briefing that day. The announcement came days after the U.S. initially halted inbound flights last Friday, after the first case.
These people have been “housed separately and are receiving medical care, and the CDC is doing control tracing and will ask people to self-isolate as needed,” Kirby added.
There have been five cases confirmed, including three at Dulles International Airport in Virginia, one at Fort McCoy in Wisconsin, and one at Fort Pickett in Virginia.
All Afghan evacuees are required to get the measles vaccine “as a condition of their humanitarian parole,” Kirby said, explaining that the Pentagon plans to get those vaccines administered at overseas safe havens.

5 – Former Clinton Consultant Believes ‘Dems on Track to Lose Big in 2022’
Breitbart reports: A Democrat political consultant has hinted that Republicans may take back the House and Senate during the 2022 midterm elections.
Douglas Schoen served as a political consultant under President Bill Clinton and worked on the 2020 Bloomberg Presidential Campaign. Schoen claimed in an op-ed that signs are pointing to a Republican landslide come next year amid abysmal poll numbers.
“The marked decline in support for President Joe Biden and his administration nationally and in key swing states indicates that the Democratic Party could endure a blowout defeat in the 2022 midterm elections,” Schoen wrote.
The political consultant outlined the dichotomy between Biden’s current position of weakness and the more stable positions that President Barack Obama and President Clinton experienced as they approached their first midterm elections:
Moreover, Biden is in a significantly weaker position now than both of his most recent Democratic predecessors — Bill Clinton and Barack Obama — at this point in their presidencies, which suggests that Democrats could suffer even more substantial losses in 2022 than the party did in 1994 and 2010.
