1.Federal prosecutors subpoena materials tied to Cuomo’s memoir, report says
Fox News — Federal prosecutors last month subpoenaed material tied to Gov. Andrew Cuomo’s memoir, “American Crisis,” from individuals who edited early versions of the book in part of their probe into COVID-19 deaths in nursing homes, the Wall Street Journal reported.
The Journal, citing unnamed sources, reported that these prosecutors from the U.S. Attorney’s Office for the Eastern District of New York Brooklyn, sought contracts and other “materials used to pitch the book to publishers.”
Michael Weinstein, a former federal prosecutor, told the paper that the materials could be valuable in the probe.
Cuomo’s administration has also been accused of engaging in a concerted months-long effort to deliberately play down the number of COVID-19-related deaths among nursing home patients in the state.
DML: If Trump did what Cuomo did with this book and the nursing homes he’d be in jail already. Keep that in mind at all times.
2.New report highlights severe intelligence failures on Jan. 6
The Hill – Senate investigators have outlined a spectacular series of intelligence and communication failures leading up to the Jan. 6 attack on the Capitol in a new report that paints the picture of a horrific scene that left lawmakers and staff scrambling for safety.
The 127-page report, which includes a transcript of former President Trump’s speech to rallygoers, is the first full congressional committee review of the deadly attack on Congress as it moved to certify President Biden’s election victory.
It pieces together multiple warnings of violence that were poorly circulated and largely went unheeded by top leaders in several agencies. That left Capitol Police forces unprepared for clashes with hundreds of protesters outside and inside the building.
The joint effort from the Senate Rules Committee and Senate Homeland Security and Governmental Affairs Committee blames bureaucratic delays in getting assistance to Capitol Police officers getting “chaotic, sporadic, and, according to many front-line officers, non-existent” instruction from commanders.

3.COVID Hospitalizations In Children ‘Modestly Lower’ Than Flu Hospitalizations, CDC Data Reportedly Shows
Daily Caller — Data from the Centers for Disease Control and Prevention (CDC) reportedly shows that in children, hospitalizations for coronavirus were roughly the same, and most likely lower, than hospitalizations for the flu.
For adolescents ages 12 to 17, the rate of hospitalization for coronavirus was about three times higher than the rate of hospitalization during a typical flu season, New York Times senior writer David Leonhardt found. Coincidentally, for children ages 5 to 11, the rate of hospitalization for the flu during a typical season is about three times higher than the rate of hospitalization for adolescents.
CDC data also reportedly shows that adolescents were hospitalized at .25 times the rate of children ages 5 to 11 for coronavirus symptoms.
The adolescent hospitalization rate for Covid-19 symptoms appears to be roughly 3x the adolescent hospitalization rate for flu symptoms during a typical season…

4.Biden Admin backs Trump in rape defamation case
Daily Mail – Joe Biden’s Justice Department is continuing to defend Donald Trump in the defamation lawsuit brought by rape accuser E. Jean Carroll, saying he can’t be held liable for his ‘crude and disrespectful’ comments because he was acting within his scope as president at the time.
Justice Department lawyers argued in a brief Monday that the US government should be allowed to replace Trump as the defendant, paving the way for him to be given immunity over his comments and the suit against him to be dropped.
Carroll, a former Elle magazine columnist, came forward at the height of the #MeToo movement in 2019 to accuse the then-president of raping her back in 1996.
Trump denied the allegations claiming she was ‘totally lying’ to sell her new book, was ‘not my type’ and that he had ‘never met’ her.
His comments prompted Carroll to sue him for defamation later that year.

5-Obama: Worrisome Republicans ‘Cowed’ to Neo-Nazi-Praising Trump by Assaulting Voting
Breitbart – Former President Barack Obama said Monday during an interview with CNN’s Anderson Cooper that it is cause for concern that the Republican Party “cowed” to former President Donald Trump’s claims of fraud in the 2020 presidential election by passing restrictive voting laws.

DML – Millions of people feel the election was stolen and therefore I think there is good reason to question the integrity of 2020. The Democrats won’t accept the facts that highlight wrongdoing, and they don’t want investigators to look at the voting data and mail-in ballots because they fear the results favor those who claim 2020 was a fraud. The Dems want this election to be forgotten — that’s the bottom line. But Arizona could be a stepping stone towards proving many people correct — Obama is smart enough to know this to be true. Never forget who Obama is, and what he did when president. Obama (1) ran guns to Mexico, (2) told you that you could keep your doctor if you like your doctor even though he knew it was a lie, (3) met with the IRS over 100 times while conservative groups were unfairly targeted, (4) sent pallets of cash to Iran, (5) left 4 Americans in Benghazi, (6) said he would side with Muslims, and (7) told blacks to continue to protest when the protests were really riots in Ferguson. I’m sure I’m missing about 500 more bad things, but you get the point.
