The Supreme Court on Friday rejected an appeal from former President Donald Trump to rule against funding used for the wall along the southern border.

In an unsigned order, the court sent the case back to the U.S. Court of Appeals for the Ninth Circuit with instructions to vacate its judgments. It also instructed a district court in the case to “consider what further proceedings are necessary and appropriate in light of the changed circumstances in this case,” namely that Trump is no longer president.

The article goes on to state the following:

The case, Trump v. Sierra Club, frequently made its way back to the Supreme Court after Trump announced in 2019 that he planned to declare a national emergency and reallocate funds given to him through the National Emergencies Act for the wall. Trump’s maneuver, which came amid the 2018-2019 government shutdown, raised multiple legal challenges.

The report noted that every court that took up the case ruled that then-President Trump violated the separation of powers.

The case came back to the Supreme Court in 2020 as the Sierra Club asked the court to lift a stay on an injunction that blocked border wall construction during litigation, arguing against the court’s stance that they may not have had standing to sue the administration. The court declined to lift the injunction.

Trump brought the case back to the Supreme Court to argue the Sierra Club did not have standing to sue in the first place, and the court scheduled arguments for early 2021. But the Biden administration requested the arguments to be postponed.

Biden has done away with many of Trump’s immigration policies, making the case moot, the report added.

  2. No need for the Supreme Court to be packed it looks like President Trump
    Inadvertently did that with his last two appointments.
    Can’t wait to see how they rule on 2nd amendment cases.

  3. The money was allocated for the border wall and now being removed. God have mercy on these Supreme Court Justices. Their day is coming and they will not be happy. Heaven has a wall, a country with walls will fail as we are seeing, $827 M given to other countries to build and protect their borders. To bad we American citizen are paying for security for these justices and their families. They will never experience what all Americans are with the maggots eating away at our culture, social programs, and insurance. Now the money will be used for other countries and programs for the maggots.
