John Eastman, an attorney who aided then-President Donald Trump in his efforts to overturn the results of last year’s presidential election, plans to invoke his Fifth Amendment rights in the Jan. 6 select committee’s investigation of the events leading up to the violent riot at the U.S. Capitol, according to a letter from his attorney.

Charles Burnham, Eastman’s lawyer, wrote in a letter to committee Chairman Rep. Bennie Thompson this week that his client “hereby asserts his Fifth Amendment right not to be a witness against himself in response to your subpoena.”

The article goes on to state the following:

In the letter, Burnham wrote, “Members of this very Committee have openly spoken of making criminal referrals to the Department of Justice and described the Committee’s work in terms of determining ‘guilt or innocence.’”


The letter continues, “Dr. Eastman has a more than reasonable fear that any statements he makes pursuant to this subpoena will be used in an attempt to mount a criminal investigation against him.”

According to the report, Eastman reportedly worked with Trump to try and get the 2020 election overturned. He also is said to have tried to convince then-Vice President Mike Pence to decertify the election results.

The report also states that Eastman allegedly tried to get swing states to deny Biden’s win and have these states send alternate electors to the Electoral College. Eastman also spoke during the rally on Jan. 6 alongside Rudy Giuliani prior to the riot taking place.

Communications Director for the Claremont Institute, Nick Short tweeted Friday, “The name of the game Congress is playing with its partisan inquisition is intimidation. John Eastman is right to resist. Every American who cares about our Constitutional rights should support him.”

Congressional reporter for The Guardian, Hugo Lowell tweeted, “Guardian US: Move by Eastman to invoke Fifth Amendment appears to suggest a growing fear among some of Trump’s closest advisors that their testimony may implicate them in potential criminality.”

Politico reporter Kyle Cheney tweeted, “NEWS: John Eastman, the attorney who worked with Trump to overturn the 2020 election results, will plead the Fifth to the Jan. 6 committee, his lawyer revealed.”

“In the letter, Eastman’s attorney Charles Burnham lodges a series of procedural complaints against the Jan. 6 committee, claiming Speaker Pelosi’s decision to reject GOP appointees makes the committee defective. He asserts Eastman’s innocence, but adds ‘Dr. Eastman has a more than reasonable fear that any statements he makes pursuant to this subpoena will be used in an attempt to mount a criminal investigation against him.'”

  1. they’re not fearing they’re tired of the bs from the constant unnecessary witch hunts. these democrats fear trump and are trying to break him financially with litigation. all soros backed bs and these assholes should have to pay for the snipe hunts out of their own pockets and not ours the american taxpayers

  2. Smart move. This committee and its chairman are only out for blood. They are only interested in causing trouble for anyone who backed Trump.

    • Well, the committee is unconstitutional and unfair to begin with. There are suppose to be equal number of Republican and Democrat members, but Pelosi wouldn’t accept the Republicans that McCarthy chose to serve on the committee (who were Trump advocates). Do Nancy accepted who she wanted (who are anti-Trumpers). Plus, the. Omitted members have made so many threats of indictments and prosecutions if you don’t comply with their demands, that no one wants to cooperate knowing they may try to twist what you say or not allow you to respond to the false accusations they may have impose upon you. I couldn’t blame Eastman.

  3. Once again, just like Rittenhouse, the media and Democrats claim a person is guilty when they remain silent or invoke their constitutional rights. American Justice system is dead, if the Democrats get away with this bullying and bull crap.
