A federal judge dismissed a lawsuit brought by female high school athletes who claimed that Connecticut’s policy of allowing students to compete in sports based on gender identity deprived them of fair competition due to the participation of two transgender students.

Selina Soule, Chelsea Mitchell, Alanna Smith and Ashley Nicoletti had sued the Connecticut Association of Schools and several local school boards, claiming that transgender students Andraya Yearwood and Terry Miller had an unfair biological advantage. On Sunday, U.S. District Court Judge  Robert Chatigny dismissed the case because Yearwood and Miller had both graduated, rendering the case moot.

The article goes on to state the following:

“I conclude that the request to enjoin enforcement of the CIAC policy has become moot due to the graduation of Yearwood and Miller, whose participation in girls’ track provided the impetus for this action,” Chatigny wrote in the court’s ruling. “There is no indication that Smith and Nicoletti will encounter competition by a transgender student in a CIAC-sponsored event next season.”

The judge also said in the ruling, “If it turns out that a transgender student does register to compete in girls’ track next season, Smith and Nicoletti will be able to file a new action under Title IX along with a motion for a preliminary injunction.”

Smith said in a statement released by the Alliance Defending Freedom, “Today’s decision is disheartening for athletes like me who train hard every day to be our physical and mental nest at the starting block. Biology—not identity—is what matters on the field, and that’s why I will continue to stand up to restore fairness to my sport.”

General Counsel Kristen Waggoner posted a series of tweets with statements from the girls. Waggoner said, “JUST IN: Young women and girls like Alanna, Chelsea, Selina, and Ashley have been sent a harmful message from the Court: their rights as women do not matter. Today, the court wrongly dismissed the girls’ case. Women deserve equal opportunities, but those opportunities are denied when policies like the CIAC’s force female athletes to compete against biological males.”

  1. I would suggest they don’t name specific Trans people and instead use an all encompassing statement, i.g., “All Trans students will not be allowed to participate in women’s sports”. At least for high school and colleges.

  2. That judge should be removed from the bench. Its not a moot point. We need to prevent this from happening in the future

  3. Are these people out of their minds? Of course transgender women have a huge advantage over biological women. Anyone with half a brain knows this. The Left and Democrats need to stop with this harmful rhetoric. If they want to run against women than let them run against other transgender women. Then it would at least be fair.

    • There isn’t enough of them to do that. But I agree with you if you were:

      Born with a penis-Mens Sports
      Born with a vagina- Women’s Sports

      The way God meant it to be.

  4. No Judge its not moot, the school rules and state laws are still in the books AND actively being enforced.

    That’s like saying well there was a train accident where 200 people died and the train operator was drinking vodka and texting while going down the wrong track, BUT the accidents over, so the case of whether the operator was grossly negligent or not is moot. Guess you subscribe to the ” Hillary Clinton – its over, what does it matter” philosophy! How the hell did you ever become a Judge? – resign for gross incompetence

  5. Why is it so difficult to understand what sex you are? Take a nice long gander between your legs. That should clear it up once and for all if you have half a mind.

  6. Don’t like the ruling. But it is correct they have no standing you can’t sue someone if there are no damages. Next time someone’s who’s competing against transgendered male. You Title Nine and lost dollars in potential. That will give you standing and demonstrably potential and real losses .

  7. Do you think if the un Supreme Court was asked to decide between wheat or white they might reach a decision? Sorry that was terrible example since one is brown and one is white !

  8. Having transgender boys playing and competing with young girls is just plain wrong. The transgender boys are still built like a boy and have the strength of a boy. It should never ever be allowed in our society. 😡😡😡😡😡😡😡😡😡😡😡😡😡😡😡😡😡😡😡😡
