An attorney for four men accused of raping a Louisiana State University student less than an hour before she was hit and killed by a car says he has video proof they did not assault the teenager.

Madison ‘Madi’ Brooks, 19, had been out drinking at Reggie’s bar in East Baton Rouge, Louisiana, on January 14 when she was approached by the group.

A 17-year-old boy, who has not been identified, has been charged with third-degree rape, along with Kavion Washington, 18.

The teen, Washington, Washington’s uncle, Everett Lee, 28, and Lee’s friend Casen Carver, 18, were all arrested and charged as in a third-degree rape allegation after the student died.

In Louisiana, a third-degree rape charge refers to a rape wherein the victim is unable to consent as they are under heavily under the influence of alcohol or drugs , and the offender “knew or should have known of the victim’s incapacity.”

The men say Brooks was in a “drunken state” when they crossed paths with her, but that she consented to contact and willingly entered the vehicle they were in.

They later dumped her at the side of the road, where she was struck by a ride-share car at around 3am.

According to legal documents, Madi had 0.319g per cent of alcohol in her system. the levels were “so high that toxicologists said she could have suffered from alcohol poisoning or loss of consciousness,” the Mail reports.

Reggie’s bar had their license to serve following the incident, the “seriousness of the allegations and potential threat to public safety” being cited as the reason.

A lawyer for the defendants claims there is video proof that Brooks willingly participated in the sexual activity and that she was in a “coherent state” and “knew what was happening.”

  1. I don’t like the dumped on the side of road !! That shows guilt !!! Who just dumped somebody along the side if the road, unless guilty of something with them!!! I don’t care if rape or not! They dumped her where she could be ran over!!! That’s intential murder!!!!

  2. Why is a 28-yr-old man hanging around with three teenagers? ANYBODY would have been able to see this girl was totally inebriated if she still had a blood alcohol reading of almost .32 hours later. There is also missing from this article whether or not all the men were in the bar drinking as well???

    All in all, very disturbing.
