President Biden conceded Friday that Democrats currently lack the votes to alter the legislative filibuster to pass abortion rights legislation, adding that the party’s goal should be to pick up two seats in the midterm elections to do so.

Biden’s comments came a day after he called on senators to change the filibuster — a rule which means 60 votes are needed to end debate on most legislation — to enable lawmakers to pass legislation codifying Roe v. Wade, the landmark abortion ruling overturned by the Supreme Court last week.

“Ultimately, Congress is going to have to act to codify Roe into federal law,” Biden said during a virtual meeting with Democratic governors on reproductive rights Friday afternoon.


He said, “The filibuster should not stand in the way of us being able to do that, but right now we don’t have the votes in the Senate to change the filibuster. That means we need two more votes.”

Biden continued, “More senators and a House majority elected in November to get this bill to my desk. So the choice is clear: we either elect federal senators and representatives who will codify Roe, or Republicans will elect the House and Senate and will try to ban abortions nationwide. Nationwide. This is going to go one way or the other after November.”

RNC Research tweeted Friday, “Biden: ‘The filibuster should not stand in the way’ of us legalizing abortion nationwide until birth.”

CBS News wrote, “Pres. Biden said Congress needs to act to codify Roe v. Wade into law but that ‘right now, we don’t have the votes in the Senate to change the filibuster. We either elect federal senators who will codify Roe, or Republicans who will… try to ban abortions nationwide.'”

Biden tweeted Thursday, “We have to codify Roe vs. Wade into law. If the filibuster gets in the way, we should provide an exception to the filibuster to deal with the Supreme Court decision.”

  2. Biden seems pretty confidence about only needing two seats!! Are they going to cheat again! From my understanding Biden is going to need a lot of seats because I’m pretty sure the American people are fed up with the southern border, high inflation and Afghanistan.
