As the trial for former Minneapolis police officer Derek Chauvin over the death of George Floyd was coming to a conclusion on Monday, Hennepin County District Judge Peter Cahill admitted that comments by Rep. Maxine Waters may result in the entire trial being overturned.

Waters went to Minnesota Saturday night to join Black Lives Matter demonstrators outside the Brooklyn Center Police Department building, and declared, “We’re looking for a guilty verdict, and we’re looking to see if all the talk that took place after they saw what happened to George Floyd… if nothing happens, then we’ve got to not only stay in the streets, but we’ve got to FIGHT for justice. But I hope that we’re going to get a verdict that says ‘guilty, guilty, guilty.’ If we don’t we cannot go away.”

“We’ve got to stay on the streets. We’ve got to get more active. We’ve got to get more confrontational. We’ve got to make sure that they know we mean business!” Waters said.

After the jury had been sequestered to begin deliberations on Monday afternoon, Chauvin’s defense attorney Eric Nelson brought Waters’ remarks to the judge’s attention, saying it could have prejudiced the jury and was grounds for a mistrial.

“We have U.S. representatives threatening acts of violence in relation to this specific case, it’s mind boggling,” Nelson told the judge.

Judge Cahill denied the motion for a mistrial, but said, “Well, I’ll give you that Congresswoman Waters may have given you something on appeal that may result in this whole trial being overturned.”

“I wish elected officials would stop talking about this case, especially in a manner that is disrespectful to the rule of law and to the judicial branch and our function. If they want to give their opinions they should do so … in a manner that is consistent with their oath to the Constitution,” Cahill said.

The judge added that the jury had been told not to watch the news, and “I trust they are following those instructions.”

NewsBusters editor Curtis Houck explained, “With the jury having left the room, Chauvin’s attorney is now asking the judge about Congresswoman Maxine Waters’s comments this weekend threatening jurors.”

“After listening to Chauvin’s trial, the judge admits that Waters’s comments could be something that he could bring up and have an argument for during a possible appeal.”

CBS journalist Kate Raddatz tweeted, “Judge Cahill angrily criticizes elected officials for giving public opinions on the case. Says it’s disrespectful to the law. Calls it “abhorrent.” Judge denies the mistrial request. But said Rep. Maxine Waters comments could give them grounds for overturning results through appeal.”
